Directive 2012/18/EU of the European Parliament and of the Council of 4 July 2012 on the control of major-accident hazards involving dangerous substances, amending and subsequently repealing Council Directive 96/82/EC

Comment

By modifying several federal laws, the law enacts the Aarhus Convention with regard to the right of information, the right of procedural participation and the right to put forward a complaint before tribunals in regard to the public and to the environmental organizations; in addition, it clarifies the position of environmental organizations in relation to the Seveso- III-Directive.

Comment

The Asylum Act distinguishes between those granted asylum and those enjoying subsidiary protection with regard to family reunification. For the latter a general waiting period of three years applies. The Constitutional Court found, that this does not constitute a violation of Art 8 ECHR (private life), nor does it discriminate between strangers.

Comment

The Court ruled that Art 197 para 3 Austrian Civil Code had to be interpreted in line with the Constitution. Therefore, Art 197 para 3 leg cit allows for the adoption of a child (through one of the ex-partners) after a same-sex couple has separated.

The underlying problem was that Art 197 para 3 leg cit is referring to father and mother. According to the Court, due to the developments in society, the reference to father and mother has to be extended to same-sex parents.
